These Terms govern your use of this site and the waitlist/newsletter sign‑up. Separate terms will apply to the app itself.

By using this site, submitting your email, or interacting with our features (e.g., the waitlist, newsletter, or the on-page question), you agree to these Terms. 2) Eligibility and territory

This site is intended for individuals aged 16 or older. By submitting information, you confirm that you are at least 16 years old and that you are legally permitted to provide the data you submit. The site is intended for users located in Switzerland and the EU/EEA.

You may submit your email address (and optionally your name) to join the waitlist and receive our newsletter. We use a double opt-in process: you will only be added after confirming via the verification email. You can unsubscribe at any time using the link provided in our emails or by contacting support@focuspilot.net.

Our marketing emails comply with Swiss law (including the Unfair Competition Act’s anti-spam provisions) and with the GDPR where applicable.

5) On‑page question ("intro gate") and user content

If you choose to answer our optional on-page question about your goals, please do not include health-related or other sensitive information. By submitting an answer, you grant Nexoventis AG a non-exclusive, worldwide, royalty-free licence to use, reproduce, analyse, and adapt your text for internal research and product development, and to display it back to you on the site as part of the user experience. You retain full ownership of your content.

We reserve the right to remove or refuse any content that is unlawful, abusive, or otherwise inappropriate.

6) Accounts

You do not need an account to use this site. Do not attempt to access non-public areas, bypass security, or circumvent technical measures.

7) Acceptable use

You agree not to break the law or infringe third-party rights; probe, scan, or test the vulnerability of the site, or interfere with its operation; copy, scrape, or harvest content or emails without permission; upload malware or engage in denial-of-service attacks; or use the site to send unsolicited communications or to conduct competitive intelligence in breach of these Terms.

Your statutory rights remain unaffected where they cannot be excluded.

15) Governing law and jurisdiction

These Terms and any dispute or claim relating to them are governed by substantive Swiss law, excluding its conflict-of-laws rules and the UN Convention on Contracts for the International Sale of Goods. The exclusive place of jurisdiction is the courts of Biel/Bienne, Canton of Bern, Switzerland.

If you are a consumer domiciled in the EU/EEA, you may also benefit from mandatory consumer protection provisions and jurisdiction rules of your country of residence.

16) Severability; no waiver; assignment

If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in full force and effect. Our failure to enforce any provision will not constitute a waiver of that provision. You may not assign your rights or obligations under these Terms without our prior written consent.
